Terms and Conditions

I have read and accepted the terms and conditions of ABS Type Approval and understand that ABS defines the Original Equipment Designer or Manufacturer as the person or legal entity that has the legal right to produce the product. This agreement shall supersede and invalidate all prior representations, including any pre-existing agreements between the parties, relating to Type Approval.

I warrant and represent that I have the authority to present the product for ABS Type Approval and the authority to use and distribute all information and data supplied in support of this application for ABS Type Approval.

ABS is to be notified in writing of any product non-conformity resulting in the issuance of a Safety/Service Alert and/or Bulletin. Such an Alert and/or Bulletin, together with detailed information on the non-conformity (including root causes and the impact to the industry or asset(s) are to be made readily available to ABS. If an Alert/Bulletin is issued, an audit inquiry (and audit finding if necessary) is to be made to document what corrective measures were implemented. These include actions to quality process discrepancies that may have been a root cause to the non-conformity. Any process change and root cause analysis are to be made readily available to ABS upon request. Notifications are to be sent to abstaprograms@eagle.org.

The undersigned warrants that, in accordance with ABS Rules and International Maritime Organization (IMO) Resolution MSC.282(86), adopting SOLAS Reg.II-1/3-5.2, and the IMO MODU Code 2009, the aforementioned product does not contain any form of asbestos. This should be evidenced by a parts list which describes the materials used in fabrication of the equipment. “Asbestos” comprises any of the following six mineral names and associated "Chemical Abstracts Service" (CAS) numbers: Actinolite Ca2(Mg,Fe)5Si8O22(OH)2): CAS 77536-66-4, Amosite (Grunerite) ((Mg,Fe)7Si8O22(OH)2): CAS 12172-73-5, Anthophyllite ((Mg,Fe)7Si8O22(OH)2): CAS 77536-67-5, Chrysotile (Mg3Si2O5(OH)4): CAS 12001-29-5, Crocidolite (Na2Fe32+Fe23+Si8O22(OH)2): CAS 12001-28-4, Asbestos Tremolite (Ca2Mg5Si8O22(OH)2): CAS 77536-68-6.

Falsification of this certificate, including any alterations by an entity other than ABS, may result in actions against the culpable entity up to and including legal proceedings for the misrepresentation of this document. Measures may include but are not limited to the immediate and indefinite suspension of the certificate in question, delisting of the entity from ABS online certification database, and immediate restriction of use of the authorized ABS service logos. Upon investigation by ABS, ABS reserves the right to permanently disqualify the implicated entity or its Principals from holding any service certifications from ABS.

This certificate is intended only for the use of the individual or entity to which it is addressed, and may contain information that is privileged, confidential and exempt from disclosure under applicable law. If the reader is not the intended recipient, you are hereby notified that any dissemination, distribution or copying of this communication is strictly prohibited.

I understand and agree that the details of the product will be published on the ABS web page www.typeapproval.org. Unless otherwise mutually agreed in writing, all services rendered and certificates issued are governed by the Rules, guides, standards or other criteria of American Bureau of Shipping. The validity, applicability and interpretation of all certificates are governed by the ABS Rules and standards and the Terms and Conditions in ABS Steel Vessel Rule 1-1-Appendix 3/5.9.

ABS is committed to preserving and securing your personal data, and we never sell your data to third parties. Company shall defend, indemnify, and hold harmless ABS and its affiliates from and against any and all third party claims and liabilities (including, without limitation, reasonable attorneys’ fees and costs), regardless of the form of action, arising out of or in connection with a claim that the service(s) offered by Company for which Company has sought recognition from ABS, infringes, violates, or misappropriates a valid third party patent, copyright, or other proprietary right, provided that Company is promptly notified inwriting of such claim, and ABS has not reached any compromise or settlement in such action or made any admissions in respect of the same.
