USCG Policy on Banning of Foreign Vessels 

The United States Coast Guard (USCG) has issued a policy letter on the “banning of foreign vessels”. A foreign vessel that has been detained by the USCG three times within the previous 12 months will be subject to an International Safety Management (ISM) Code expanded examination where there are clear grounds to believe that the ship has not effectively implemented its Safety Management System.

If, after review, the USCG determines that adequate measures have not been taken to prevent future noncompliance, the USCG will issue a Letter of Denial to the vessel's owner and company informing them that the vessel will be denied entry into any port or place in the US unless specific actions are completed to the satisfaction of the USCG. When satisfied that the required actions have been taken, the USCG will issue a Letter of Acceptance. Upon the vessel's return to the US, it will be subjected to a Priority I Port State Control (PSC) Exam prior to entry.
